This Privacy Policy explains how we collect, use, disclose, and safeguard information when you visit our websites atheon-inc.com and atheon.ad (the "Site") or use our AI product analytics platform, APIs, and associated SDKs (the "Service").

By accessing or using the Site or Service, you agree to the practices described in this Privacy Policy.

I. Definitions

For purposes of this Privacy Policy:

  • "Customer Data" means data submitted to the Service by or on behalf of a Customer through APIs, SDKs, or other integrations.
  • "Derived Data" means data generated by Atheon through aggregation, anonymization, statistical analysis, or transformation of Customer Data that does not identify any individual or Customer and cannot reasonably be used to do so. We may internally refer to certain forms of Derived Data as Fingerprint.
  • "You" refers to a user of our Site or Service.

A. Information You Provide

We collect Personal Information you voluntarily provide, including when you:

  • Register for an account

  • Subscribe to communications
  • Participate in surveys or feedback programs

Customers are responsible for ensuring that their use of the Service complies with applicable data protection laws.

E. Customer Data and Derived Data

Customers may submit data about their products, systems, or users ("Customer Data") when using the Service.

Customers retain all rights, title, and interest in their Customer Data.

Atheon processes Customer Data solely for the purpose of operating, maintaining, and improving the Service.

Atheon may generate Derived Data through aggregation, anonymization, and statistical analysis of Customer Data.

Derived Data:

  • does not identify any individual or Customer
  • cannot reasonably be used to identify any person
  • may be used to improve or operate the Service

Derived Data may be retained and used indefinitely provided it remains de-identified.

F. Children's Privacy

The Service is not directed to children under the age of 13.

In accordance with the Children's Online Privacy Protection Act (COPPA), we do not knowingly collect Personal Information from children under 13.

If we become aware that we have collected Personal Information from a child under 13, we will delete it promptly.

III. How We Use Information

Unless expressly agreed otherwise, Customers should not submit sensitive personal data, including:

  • health or medical information
  • financial account numbers
  • government identification numbers
  • biometric identifiers
  • information relating to children

Atheon is not responsible for Customer Data submitted by Customers or their end users.

V. AI Model Interaction Data

The Service may process information related to interactions with artificial intelligence systems, including prompts, responses, configuration parameters, and related telemetry.

This information is processed solely to provide analytics, debugging, monitoring, and operational insights.

Atheon does not use Customer Data submitted through the Service to train foundation models unless explicitly authorized by the Customer.

VI. How We Share Information

A. Service Providers

We may share information with trusted third-party vendors that help operate the Service, such as:

  • cloud infrastructure providers
  • llm inference providers
  • hosting providers
  • monitoring and security vendors
  • email delivery services

These providers are contractually obligated to protect Personal Information.

B. Legal Requirements

We may disclose information when required by law or when necessary to:

  • comply with legal obligations
  • enforce our agreements
  • protect the security of the Service
  • protect the rights or safety of Atheon or its users

C. Business Transfers

If Atheon undergoes a merger, acquisition, or asset sale, user information may be transferred as part of that transaction.

Users will be notified if their information becomes subject to a materially different privacy policy.

D. Aggregated and Derived Data

We may use and share aggregated or anonymized information, including Derived Data, for analytics, research, benchmarking, or reporting purposes.

Such information does not identify any individual or Customer.

VII. Security and Abuse Prevention

We monitor the Service to detect, investigate, and prevent fraud, abuse, security incidents, and violations of our Terms of Service.

This monitoring may include automated analysis of logs, telemetry, and system activity.

Information collected for security purposes may be retained longer when necessary to protect the integrity of the Service.

VIII. Data Retention

We retain Personal Information only as long as necessary for the purposes described in this policy.

Typical retention periods include:

  • Account information: retained while the account remains active
  • Support communications: up to 24 months
  • System logs and telemetry: retained for operational and security purposes

When Personal Information is no longer needed, it will be securely deleted or anonymized.

XI. Data Processing Agreement

When Atheon processes Personal Data on behalf of Customers subject to applicable data protection laws, Atheon acts as a data processor and the Customer acts as thedata controller.

Customers may request a Data Processing Addendum (DPA) governing such processing by contacting privacy@atheon-inc.com.

XII. Do Not Track Signals

Some web browsers offer a "Do Not Track" feature that signals websites that you do not want your online activity tracked. Our Service does not currently respond to Do Not Track signals.

XIII. Benchmarking and Industry Insights

Atheon may generate anonymized and aggregated insights regarding trends in AI system performance, usage patterns, or operational metrics.

These insights will never identify any Customer, individual, or end user.

XIV. Security

We implement administrative, technical, and organizational safeguards designed to protect Personal Information. These safeguards include:

  • encryption of data in transit using TLS
  • encryption of sensitive data at rest
  • access controls and authentication
  • security monitoring and incident response procedures

No method of transmission or storage is completely secure. In the event of a data breach affecting Personal Information, we will notify affected users as required by law.

XVI. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. If material changes are made, we will provide notice through the Site or by email.

The "Last Updated" date reflects the most recent revision.
